Aviron Referral Program Terms of Service

• These terms and conditions (“Referral Terms”) constitute a legal agreement between you and Aviron Interactive Inc. (“Company” or “Aviron”).
• As used in these Referral Terms:
• “our”, “us”, “we” and any other similar variation refer to Aviron Interactive; and “you” and “your” refer to the individual participant, as the party agreeing to these Referral Terms.
• The referral program is available in North America only.
• We will only count referrals on links that are automatically tracked and reported by our system.
• We will not credit a referral if someone says they signed up or someone says they entered a referral code and it was not tracked by our system.
• We reserve the right to change the terms of service for our referral program at any time. You may not use our referral program for any illegal or unauthorized purpose. You must not violate any laws in your jurisdiction.
• Participation in this Referral Program is also subject to Aviron's Terms of Service and Aviron's Privacy Policy, and by participating in the Referral Program you agree to the same.
• With respect to the Referral Bonus, you will receive the Referral Bonus (if eligible) via Tango Card to the email address used to generate your unique referral link, and with respect to a Qualified Referral, their purchase will be discounted by the agreed amount at time of purchase.
• Any Referral Bonus will be paid approximately 30 business days after your referral receives their Aviron rower.
• We reserve the right, at our sole discretion, at any time, and without notice, to change, modify, suspend, or revoke all or any part this Referral Program (including the manner of payout, the eligibility requirements and any rights hereunder), including, without limitation, for any person we find or believe to be manipulating or otherwise abusing the process, fairness, or integrity of the Referral Program or that otherwise in our discretion becomes ineligible. We may, to the maximum extent permitted by applicable law and in our sole and absolute discretion, change, modify, suspend or revoke all or any part of this Referral Program or these Referral Terms (including the manner of payout, the eligibility requirements and any rights hereunder) or at any time without reason or notice you, or modify, suspend or cancel the Referral Program if any fraud, technical failures, unauthorized human intervention or other causes or factors beyond our control impair or corrupt any aspect of the Referral Program, including, but not limited to, the administration, security, fairness of the Referral Program or the submission of referrals. We may, in our sole and absolute discretion, disqualify any individual found, without limitation, we find or believe to be: (w) tampering with the referral process or the operation of the Referral Program; (x) acting in violation of these Referral Terms, our Terms of Service or any other agreement you may have with us; (y) manipulating or otherwise abusing the process, fairness, or integrity of the Referral Program or that otherwise in our discretion becomes ineligible; or (z) acting in an unsportsmanlike or disruptive manner or with intent to abuse, frustrate, annoy, demean, threaten or harass any other person. If your referral submission is incomplete or if you use robotic, scripts, macros or other automated or programmed methods, your submission will be automatically void. Referral Bonus obtained through fraudulent activities or activities in violation of the terms and conditions hereunder, or the representations contained herein, will be null and void. Any attempt by any person to deliberately undermine the legitimate operation of the Referral Program may be a violation of criminal and civil law, and, should such an attempt be made, Company reserves the right to seek damages from any such person to the fullest extent permitted by law. Company's failure to enforce any term of these Referral Terms shall not constitute a waiver of that clause. By sending a referral, you hereby confirm that the referred party is aware of such intended referral, and has granted its consent to being contacted by Aviron to discuss Aviron's products/ services.
• All amounts referenced above are, with respect to customers in the US, in US dollars, with respect to customers in Canada, in Canadian dollars.
